Okorocha Takes Uzodimma to Court Over Imo West APC Senatorial Ticket
Former Governor Rochas Okorocha has asked the Federal High Court in Abuja to nullify Governor Hope Uzodimma’s nomination as the All Progressives Congress (APC) senatorial candidate for Imo West.
In a suit marked FHC/ABJ/CS/1854/2026, Okorocha is challenging the Independent National Electoral Commission’s (INEC) decision to publish Governor Uzodimma as the winner of the primary election.
Key Arguments Raised in the Lawsuit
Okorocha’s legal team, led by attorney O.J. Aboje, has asked the court to address several core issues:
-
Disputed Primary Election Results: An affidavit filed by Okorocha’s son, Amen Rochas, asserts that Okorocha secured 150,780 votes against Uzodimma’s 102,158 votes in the direct primary. He argues that official monitoring reports reflect his victory rather than the declared result.
-
Constitutional Eligibility: The suit highlights Section 183 of the 1999 Constitution, which prohibits a sitting governor from holding another executive office or paid position while in office.
-
Requested Legal Reliefs: Okorocha is asking the court to declare the publication of Uzodimma’s name void and to issue an order directing the party and election authorities to recognize him as the valid candidate.
The suit names INEC, Governor Hope Uzodimma, and the All Progressives Congress (APC) as co-defendants.
