$1.3 Billion Medicare Scheme: Georgian National Indicted in Record Health Care Fraud Case

Federal prosecutors in Boston have unsealed a major indictment in one of the largest health care fraud prosecutions in U.S. history.

A federal grand jury charged Erekle Gugava, a 33-year-old Georgian national, with conspiracy to commit money laundering. Federal officials allege that Gugava played a central role in laundering money generated by a massive $1.3 billion health care fraud network.

The case stems from Operation Gold Rush, a global sweep by the U.S. Department of Justice (DOJ) targeting foreign syndicate networks that exploit American healthcare programs.

Key Highlights of the Indictment

  • Defendant: Erekle Gugava, 33, a citizen of Georgia who was illegally residing in the U.S.

  • Front Company: ND Medical Solutions, LLC (located in Pennsylvania).

  • Fraudulent Claims Billed: Over $1.3 billion in a span of just five months.

  • Actual Payouts: Approximately $6.5 million received from insurers.

  • Primary Targets: Medicare, private supplemental insurers, employer health plans, and union health funds.

  • Current Status: Gugava fled the United States in July 2025 and remains at large.

How the $1.3 Billion Scheme Worked

The overall operation was orchestrated by a Russia-based transnational criminal organization. The group created fictitious claims for Durable Medical Equipment (DME)—such as back braces, knee wraps, and mobility aids—and billed them directly to Medicare and private health plans.

Gugava’s role was critical to the financial pipeline:

1. Setting Up the Front

Between February 2025 and July 2025, Gugava posed as the owner of ND Medical Solutions, LLC, a Pennsylvania-based medical equipment supplier.

2. Identity Theft on a Massive Scale

The syndicate stole the identities of elderly and disabled citizens across Massachusetts, New England, and the wider United States. The organization submitted fake medical bills using stolen doctor credentials and patient names. Victims only realized what happened when they received Explanation of Benefits (EOB) statements listing equipment they never ordered or received.

3. Exploiting Systemic Trust

Because the reimbursement checks originated from legitimate sources like Medicare and established insurance providers, the money looked completely clean when deposited. Gugava opened multiple corporate bank accounts as sole signatory, deposited the insurance payouts, and systematically transferred the funds to overseas bank accounts controlled by the syndicate.

What Is Operation Gold Rush?

Operation Gold Rush is the Department of Justice’s flagship initiative against international healthcare fraud rings. Foreign-based rings frequently target U.S. social safety net programs because the billing systems rely on rapid processing schedules.

This prosecution was driven by a collaboration of multiple federal agencies:

  • U.S. Attorney’s Office (District of Massachusetts)

  • DOJ National Fraud Enforcement Division

  • Department of Health and Human Services – OIG

  • Federal Bureau of Investigation (FBI)

  • Internal Revenue Service – Criminal Investigation (IRS-CI)

  • Homeland Security Investigations (HSI)

  • U.S. Postal Inspection Service (USPIS)

What Penalties Does the Defendant Face?

If convicted of money laundering conspiracy, Gugava faces severe federal penalties:

Penalty Type Maximum Potential Sentence / Fine
Prison Time Up to 20 years in federal prison
Supervised Release Up to 3 years
Financial Fine Up to $500,000, or double the laundered amount

Note: Under federal law, sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines.

Broader Impact: Fraud Enforcement On the Rise

This indictment arrives during a period of heightened federal scrutiny on government benefit programs.

  1. National Fraud Enforcement Division: Established by the DOJ in April 2026, this division specifically targets complex, international fraud schemes against American citizens.

  2. Benefit & Voter Fraud Taskforces: U.S. Attorney Offices nationwide are setting up targeted teams to catch criminal networks exploiting federal programs.

  3. Health Care Fraud Strike Force Network: Since 2007, the Health Care Fraud Strike Force has charged over 6,200 defendants who collectively billed federal and private insurers for more than $45 billion.

How to Protect Yourself from Medicare Fraud

Identity theft is the fuel that runs these multi-billion-dollar schemes. Protect yourself and your loved ones with these steps:

  • Review Statements Carefully: Always inspect your Medicare Summary Notices (MSNs) or Explanation of Benefits (EOBs) for unauthorized charges.

  • Protect Personal Information: Never share your Medicare number or Social Security number with unsolicited callers or unverified online offers.

  • Report Suspicious Claims: If you see medical equipment listed on your records that you never received, contact your provider or report it directly to federal authorities.
